Privacy Statement

Tcard Website Privacy Policy

This Privacy Policy applies to all the publicly accessible pages on the Tcard website. The NSW Ministry of Transport does not have any responsibility for the privacy policies or practices of third party sites linked to this website.

Users of the Tcard website are entitled to expect that any information gathered as a result of that use will be treated within the terms of the New South Wales Government's privacy responsibilities and obligations. The New South Wales Government's privacy practices are regulated by the Privacy and Personal Information Protection Act 1998 (NSW).

What information do we collect?

When you look at the pages on this website, the computers on which the site is hosted automatically record information that identifies, for each page accessed:

  • The IP (Internet Protocol) address of the machine which has accessed it;
  • Your top-level domain name (for example .com, .gov, .au, .uk, etc.);
  • The address of your server;
  • The date and time of your visit to the site;
  • The pages accessed and documents downloaded;
  • The previous site or page visited;
  • The time you spend browsing the site; and
  • The type of browser and operating system you have used.

Cookies are not used on this site to collect information. Nor does the NSW Ministry of Transport link information automatically gathered through this website with personal data about specific individuals.

How do we use the information collected?

The information collected during each visit is aggregated with similar logged information and published in statistical reports in order for the NSW Ministry of Transport to identify usage patterns for the site. This will assist us in improving the Tcard website and the services offered on it.

The NSW Ministry of Transport will not disclose or publish information that identifies individual machines, or potentially identifies sub-groupings of addresses, without consent or otherwise in accordance with the Privacy and Personal Information Protection Act 1998 (NSW).

What exceptions are there to this rule?

The NSW Ministry of Transport will collect, use and disclose more extensive information than stated above in the following circumstances:

  • Unauthorised attempts to access files which are not published on the Tcard website pages;
  • Unauthorised tampering or interference with files published on the Tcard website;
  • Unauthorised attempts to index the contents of the Tcard website by other sites;
  • Attempts to intercept messages of other users of the Tcard website;
  • Communications which are defamatory, abusive, vilify individuals or groups or which give rise to a suspicion that an offence is being committed; and
  • Attempts to otherwise compromise the security of the web server, breach the laws of the State of New South Wales or Commonwealth of Australia, or interfere with the enjoyment of the Tcard website by other users.

The NSW Ministry of Transport reserves the right to make disclosures to relevant authorities where the use of the Tcard website raises a suspicion that an offence is being, or has been, committed.

In the event of an investigation, the NSW Ministry of Transport will provide access to data to any law enforcement agency that may exercise a warrant to inspect our logs.

Is the information stored securely?

Yes. Information collected is stored in an appropriately secure format and held for archival purposes. When the information is no longer required for the purposes for which it was collected it is deleted.

Who else has access to information within the Ministry?

The information is captured on the computers on which the site is hosted. Access to the raw data is restricted to a limited number of officers in the NSW Ministry of Transport for the purpose of analysis and to report on the success of the Tcard website in meeting the NSW Ministry of Transport's communication and access objectives.

Statistical reports prepared from the raw data are circulated among selected officers inside the NSW Ministry of Transport.

What happens to emails gathered from the website?

Any email sent to the NSW Ministry of Transport via links from the website is assessed then passed onto the most appropriate officer within the Ministry. Replies to emails, including the original message, are treated as official records and are saved and archived.

Will this policy be updated over time?

Due to the developing nature of privacy principles for online communication, this policy may be modified or expanded in light of new developments or issues that may arise from time to time. The amended policy will be posted to this site and will operate from the time it is posted.

Tcard Privacy Statement

Protecting the personal information of Tcard users is a priority for the Public Transport Ticketing Corporation ("Tcard"). This statement covers privacy for School Tcard, Commuter Tcard, and Transport Operator Employee Tcard. It outlines the type of information collected by Tcard, how it is used in the operation of the Tcard Ticketing System, and how the privacy rights of individuals are protected.

Privacy rights

The privacy rights of individuals are protected NSW through the Privacy and Personal Information Protection Act 1998 and by Commonwealth legislation through the Privacy Act 1988.

Tcard is committed to operate the Tcard Ticketing System in accordance with the law to ensure the privacy rights of individuals are respected.

Personal information

Personal information is any information or an opinion (including information or an opinion forming part of a database and whether or not recorded in a material form) about an individual that can be used to identify or be linked to that person. This includes information such as a cardholder's name, date of birth, address and contact details.

Tcard will only collect personal information supplied directly by cardholders (or someone authorised to do so on their behalf - eg parents and guardians in the case of school students).

Personal information will only be held by Tcard where it is directly related to the Tcard Ticketing System.

Instances where personal information will be collected and held include:

  • if a cardholder (other than a child) has a card providing travel at concession fares;
  • if a cardholder wants to register their Tcard;
  • if an individual agrees to receive information about Tcard promotions or activities.

Personal information may be used to:

  • manage transport concession entitlements (where applicable);
  • provide cardholder services, including when cardholders log-in to an online Tcard account or ring the call centre;
  • provide information about Tcard products and services;
  • undertake research and staff training;
  • fulfil legal requirements (such as disclosure to law enforcement agencies and courts).

Privacy legislation restricts the collection of sensitive personal information. Tcard will not collect information relating to religious or philosophical beliefs, ethnicity, political opinions, trade union membership, criminal record, sexuality or any similar subjects.

Remaining anonymous

A cardholder can remain anonymous (not provide any personal information) by using an unregistered Tcard.

The only instance where a person will be required to provide personal information and register their Tcard is if an adult wishes to claim a travel concession or if they are a school student travelling by means of the SSTS.

Travel information

Travel information is collected when a Tcard is tagged at a Tcard Reader. This information is used to:

  • calculate the value of the trip so a fare can be deducted;
  • make payments to transport operators for travel if the cardholder is entitled to a concession.

Aggregated travel data may also be used to assist with providing cardholder services for transport planning. Individual travel data may be used to fulfil legal obligations.

A registered Tcard user will be able to arrange access to their information through an online account.

Protecting information

Personal information and travel data is stored in secure computer systems which have security features compliant with legislative requirements and Australian Standard AS/NZS 17799 Information Security Manangement, Code of Practice for information security manangement.

Where information is transmitted, dedicated telecommunication lines are used and information is encrypted.

Contained in the computer chip on the Tcard is the concession status of the cardholder (if applicable), the Tcard number and the value of any money or tickets loaded on the card. This information does not identify the cardholder, and is protected by a system of encryption keys unique to each card.

Generally Tcards have no personal information printed on them, however, School Student Transport Scheme Tcard users will have their name and date of birth printed on the Tcard. Tranport Operator Employee Tcards may also have personal information printed on the Tcard.

Access to personal information is limited to the individual concerned, Tcard staff or contractors who are authorised to access the specific information necessary to carry out thier specific duties. Tcard employees are bound by the PTTC Code of Conduct and confidentiality requirements in employment agreements. Contractors are also bound by confidentiality agreements.

Access to information

Registered Tcard users can access their personal information and travel data held by Tcard.

Information can also be corrected or updated if cardholder details have changed.
